Maharashtra labour rules

Maharashtra rules a Pune employer should check

Maharashtra has its own rules on professional tax, welfare fund, shop registration and working hours, several of which changed recently. These are the ones that matter for contract and temporary staff.

Rule What applies in Pune What we handle
Minimum wages Fixed by scheduled employment in three zones. Zone I covers municipal corporation areas and industrial areas within 20 km of them, which includes most of Pune, Pimpri-Chinchwad and the nearby MIDCs. A special allowance (VDA) is revised every January and July. For shops and establishments, Zone I unskilled rates were about ₹14,150 a month from 1 July 2026. Engineering and other schedules have their own rates. We confirm the schedule and zone for your site address, and apply each January and July revision.
Professional tax Monthly. Men: nil up to ₹7,500; ₹175 for ₹7,501–₹10,000; ₹200 above ₹10,000 (₹300 in February). Women: nil up to ₹25,000. From March 2026, employers must pay by the 15th of the following month. We register (PTRC), deduct by gender and slab, and pay by the 15th.
Labour welfare fund Half-yearly: ₹25 from the employee and ₹75 from the employer, deducted in June and December and paid by 15 July and 15 January. We deduct and remit both instalments for every worker on our rolls.
Shops & establishments The Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act 2017 was amended in October 2025: up to 10 hours a day within 48 a week, overtime up to 144 hours a quarter, a 12-hour spread-over, and the main provisions now apply from 20 workers (smaller establishments file an intimation). We roster hours and overtime inside these limits and keep records ready for inspection.
Labour Codes & contract labour The four Labour Codes apply from 21 November 2025. Maharashtra published draft State rules in 2026, including draft OSH rules in May 2026. Until final rules are notified, earlier State rules continue where they do not conflict. Contractor licensing under the OSH Code applies at 50 or more contract workers. We confirm registration and licensing needs for your headcount before deployment and track the final rules.
Women at night Women may work night shifts in factories and establishments with their consent and the safeguards the State sets: transport, security and a functioning Internal Committee. We keep written consent on file and check transport before rostering.

Many workers come from Marathwada, Vidarbha and other States, and go home for Diwali and the harvest. Some do not come back. We plan a standby list and a return-date check before these breaks.

Do you have an office in Pune?+

How is professional tax different for women in Maharashtra?+

Women earning up to ₹25,000 a month pay no professional tax in Maharashtra. Men pay ₹175 between ₹7,501 and ₹10,000, and ₹200 above ₹10,000 (₹300 in February). We apply the right slab on every payslip.

What does a contract worker cost in Pune?+

The agreed wage, at least the Maharashtra minimum for the employment and zone, plus employer PF (12% of PF wages up to the ₹25,000 ceiling from 17 September 2026), ESI at 3.25% where gross wages are ₹21,000 or less, bonus, leave and gratuity provisions, LWF, our service fee and 18% GST. We send an itemised rate card.

Can you run our Chennai and Pune plants on one contract?+

Yes. One agreement with State-specific annexures, one payroll process, and a contact who knows Tamil Nadu and Maharashtra rules.

Do you need a contractor licence in Maharashtra?+

Under the OSH Code, which replaced the Contract Labour Act from 21 November 2025, contractor licensing applies at 50 or more contract workers. Maharashtra's final State rules were still awaited in September 2026. We confirm the requirement for your headcount before deployment.
