Since 21 November 2025, contract labour has been governed by the Occupational Safety, Health and Working Conditions Code, 2020 (the OSH Code), which replaced the Contract Labour (Regulation and Abolition) Act, 1970. The principles are familiar, but four points matter specifically in hotels.
Section 57 bars contract labour from core activities unless the work is normally done through contractors, is not full-time for most of the day, or is a sudden increase in volume. Housekeeping, laundry, canteen, security and sanitation count as non-core only where they are support services; in a hotel, rooms and F&B may well be core. A banquet surge fits the volume exception; long-term contract staffing of your restaurant floor needs a legal view.
Contractor licensing now sits under the OSH Code (formerly CLRA): a contractor with 50 or more contract workers in the preceding 12 months needs a licence, valid for five years. Ask any agency for its licence status.
Work beyond 8 hours a day or 48 a week is overtime at twice the ordinary rate. Women may work before 6 am or after 7 pm only with consent and the safety and transport conditions the State prescribes.
Pay at least the State minimum wage, on time and through the bank. PF is 12% + 12% on wages up to the ₹25,000 ceiling (raised from ₹15,000 on 17 September 2026); ESI is 0.75% + 3.25% where gross pay is up to ₹21,000.
