TRAI, DND and consent rules your telecallers must follow in 2026

TRAI amended the rules on commercial calls again on 18 September 2026. A telecaller who dials from a personal SIM, ignores a DND request or runs an undeclared autodialer can get your numbers flagged, barred or disconnected. We brief every batch on the rules below before their first login; your compliance team sets the process-specific script.

Promotional calls come from the 140 series

Under TRAI’s Telecom Commercial Communications Customer Preference Regulations (TCCCPR), promotional calls must be made from the registered 140xx series, and service and transactional calls from the 1600xx/1601xx series. Agents should never make promotional calls from personal 10-digit mobiles.

Consent

Respect DND and consent

Customers set preferences through 1909 or the TRAI DND app. Promotional calls need a clear preference or verifiable consent; under the September 2026 amendment, a customer’s own enquiry supports commercial follow-up for only seven days, and only if the enquiry is recorded in writing or digitally.

Diallers

Autodialers must be declared

The Third Amendment Regulations of 18 September 2026 treat application-to-person calls — autodialers, robocalls and pre-recorded voice — as unsolicited unless the sender has pre-declared them and their numbers to the telecom operator.

Enforcement

Complaints now act faster

Action against a sender can start after three unique complaints in ten days if the telecom operator’s AI systems have also flagged the number, with outcomes ranging from re-verification to barring and disconnection. Customers can also appeal complaint outcomes within 15 days.

RBI

Collections have extra rules

For lenders’ collections desks, RBI’s rules on recovery agents bar calls before 8 am and after 7 pm and prohibit harassment or threats. We screen collections callers for tone as well as persistence.

Agents handle names, numbers and account details. Call recording notices, clean-desk rules and named CRM logins support your obligations under the DPDP Act, 2023.

Hiring for fluency only

A fluent speaker who cannot handle a refusal will leave in a fortnight. Score the mock call, not just the conversation.

Hiding the targets until day one

The fastest way to lose half a batch is to surprise it with targets and shift timings. Show them before the offer.

Incentive-heavy pay with a low fixed

Fixed pay must meet the minimum wage on its own. A pay plan that relies on incentives to reach the floor is a compliance risk and an attrition driver.

Calling from personal SIMs

Promotional calls from unregistered 10-digit numbers breach TRAI rules and can get numbers disconnected. Provide registered lines and a declared dialler.

No compliance in the script

Identification, purpose of call, opt-out and recording notice should be in the script and on the QA form, not left to the agent.
